Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed contract is signed on a Fernhill rental property, all Healthy Homes compliance items must be taken care of by the end of 90 days.

Fernhill Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and 30 June 2021

  • Ceiling and underfloor insulation is mandatory to all Fernhill and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate the compliance with each Healthy Homes Standards that apply or will be applicable during the tenure of your rental home.

From July 1st 2021

  • Private landlords and property managers have to ensure their rental properties comply to the Healthy Homes Standard within 90 days of any new, renewed , or altered lease.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) must adhere to the Healthy Homes Standard regardless of the date when the tenancy started.

From July 1st 2023

  • All households rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rental homes have to meet the Healthy Homes Standard regardless of when the tenancy first began.

Heating Fernhill

Fernhill rental properties must have a fixed source of heat which can warm the living area to at minimum 18degC even on the most coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health as well as their mental health.
