Fines for Failing to Comply
Beginning on July 1st, 2021, if a new, renewed or varied contract is signed on a Mangateretere rental property, all Healthy Homes compliance work have to be finished inside of 90 days.
From the 1st of July in 2021, if a new or renewed lease is entered into on the Mangateretere rental property, all Healthy Homes compliance work must be finished by the end of 90 days.
Failure to adhere to each of Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance is not incorporated within a new, renewed or amended tenancy agreement there could be an additional fine or violation fee.
Any tenant may request details regarding the Healthy Homes Standard and how they relate to the home they reside in. If the property manager is unable to supply the required information within 21 days from receiving the request, they may receive an infringement notice and be fined up to $750.
In addition, there is also a penalty of approximately $900 for landlords or property managers who have provided a false or false Healthy Homes Statement of Compliance or other information. The person liable for this fine is the person who is named on the lease agreement as being the person renting the property, so it could be the name of the landlord or the property management company.
All information in the Statement of Compliance needs to be accurate before the tenancy agreement can be signed, and ideally it must be updated during the entire tenancy, as necessary work related to it is finished.
It is also important to remember that landlords who have multiple rental properties could face greater penalties for non-compliance. The most severe penalties are reserved for serious violations. Those who have at least six rental properties could be penalised up to $50,000, and even as high as $100,000 in hearings.
