Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied contract is signed on a Marewa rental property, all Healthy Homes compliance work have to be completed by the end of 90 days.

Since the 1st July of 2021, when a new, renewed or varied Tenancy is signed for a Marewa rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to comply with all of the Healthy Homes Standards inside of the anticipated timeframe could result in penalties of up to $7200. In addition, if the present Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or revised tenancy agreement, it could result in an additional fine or infringement fee.

It’s also important to remember that landlords who have multiple rental properties may face greater penalties for non-compliance. The highest penalties are given for the most serious breaches. Landlords with six or more properties could receive fines of up to $50,000 and as high as $100,000 in hearing claims.

Marewa Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to 30 June 2021

  • Ceiling and underfloor insulation is compulsory in all Marewa and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or amended tenancy agreement.
  • Landlords and property managers must keep records that prove the compliance with all Healthy Homes Standard that apply or will apply during the tenure of an apartment rental.

From 1 July 2021

  • Property managers and private landlords should make sure their rental properties comply to the Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenancy.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All households that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Insulation for underfloor and ceilings is a requirement in all rental homes since July 1, 2019. Property managers and landlords are required to ensure that the insulation meets this new standard.
