Healthy Homes Assessment Services

Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed for a Pandora rental property, all Healthy Homes compliance work need to be taken care of within 90 days.

As of 1st July 2021, if a new, renewed or varied Tenancy is signed for the Pandora rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to comply with any of the Healthy Homes Standards by the end of the deadlines can result in a fine of up to $7200. Additionally, if a existing Healthy Homes Statement of Compliance isn’t incorporated within an updated, renewed, or revised tenancy contract, there may be an additional fine or violation fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the home they live in. If the property manager is unable to provide the required information within 21 days of having received the inquiry, they will receive an infringement notice and be fined as high as $750.

Additionally, there is also a fine of up to $900 for landlords and property managers who have provided a false or false Healthy Homes Compliance Statement or other information. The person liable for this fine is the person who is listed on the tenancy agreement as the person who is leasing the property out which could be the name of the landlord as well as the company that manages the property.

The information contained in the Compliance Statement needs to be correct before the tenancy agreement can be completed, and should be maintained during the entire tenancy, as related work is completed.

It’s also important to be aware that landlords who have multiple rental properties may receive additional fines for non-compliance. The harshest penalties are given for serious violations, and landlords who own six or more properties can be penalised up to $50,000 and as high as $100,000 in the case of hearing claims.

Pandora Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is required for all Pandora and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records of their the conformance to all Healthy Homes Standard that apply or will be in force throughout the tenancy period of your rental home.

From 1 July 2021

  • Private landlords and property managers must ensure their rental properties conform to the Healthy Homes Standards within 90 days of a newly renewed, extended or changed tenant.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Pandora

Draughts are a major cause of low temperatures inside homes. A humid house will cost more to heat, meaning wasting energy and incurring higher costs.

If a draft can be perceived as a result of gaps or holes the area requirements to be sealed.

What are unreasonable gaps and holes?

If you can feel external air coming in or an unobstructed draught coming from a crack or a gap or crack, then it is likely to be a gap or an opening that needs sealing in some way. Cracks and gaps that are large should be fixed permanently. The gaps that exceed 3mm that let air in or out within your home require to be sealed. For instance, if an open fireplace isn’t being used, it can create draughts. This should be sealed off. Landlords and property managers are responsible for ensuring that draughts from the fireplace are removed in the maximum extent imaginable.

There is no need to block gaps or holes in the building. For instance, small gaps around windows and doors could be necessary to allow for movement of the structure when the house warms and cools to allow them to be closed and opened rather than sticking. Heating Pandora

Pandora rental properties must have a fixed source of heat that is able to heat the largest or main living space to a minimum of 18degC, even during the winter coldest days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating requirements to be fixed (i.e., not portable), at minimum 1.5 kW in heating capacity, and must meet the minimum heating capacity needed to heat the living space in general. The Heating Assessment Tool can be used to determine whether the existing fix heater(s) are adequate or whether you will require to "top up" by adding a second heater. Unflued combustion and open fire heaters such as portable LPG bottle heaters aren’t considered to be safe heating options under Healthy Homes Standard. Healthy Homes Standard.

If the heating system you offer is electric heating or heat source, it should include a thermostat. This makes your heating more consistent and effective. For most houses, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters are required. However, in certain instances such as small apartments an electric, fixed heater could be enough.

If your main living space already has a permanent heating source like the heat pump, it might require some additional energy in order to comply with the standards. Some types of heaters can’t be used to comply with the standard because they’re inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Pandora

Every living space in the rental property should contain at minimum one open window or exterior door to offer natural ventilation. Additionally, areas with high moisture areas such as kitchens or bathrooms should be equipped with an venting fan outside to get rid of moisture.
