Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed contract is signed on a Pirimai rental property, all Healthy Homes compliance work must be finished within 90 days.

As of 1st July 2021, when a brand new or renewed Tenancy is signed for a Pirimai rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to comply with each of Healthy Homes Standards inside of the expected timeframe can result in a fine of up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated in a new, renewed or revised tenancy contract, it could result in an additional penalty or infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the property they reside in. If the property manager is unable to supply the required information within 21 days of having received the inquiry, they can receive an infringement notice and be fined upto $750.

In addition, there’s also a penalty of approximately $900 for property owners or property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or other information. The person liable for this fine is the one who is named on the tenancy agreement as the person who is leasing the property out, so it could be the landlord’s name or the property management company.

The information contained in the Statement of Compliance requirements to be correct when the tenancy contract is executed, and it is updated throughout the tenancy as any related work is completed.

It is crucial to note that landlords with multiple rental properties could face greater penalties for non-compliance. The harshest penalties are given for serious breaches. Landlords with six or more properties can receive fines of up to $50,000, and even as high as $100,000 for hearing claims.

Pirimai Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is mandatory throughout Pirimai and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included in any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records to demonstrate compliance with each Healthy Homes Standards that apply or will apply during the tenure of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords should make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of any renewal, new or a change in Tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

  • All households let from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

Proper heating is crucial to ensure healthy houses

Heating Pirimai

Pirimai rental properties need to have a stable source of heating which can warm the largest or main living room to at least 18degC even on the winter coldest days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating requirements to be fixed (i.e., not portable), at least 1.5 kW in heating capacity, and must meet the minimum requirement for heat capacity in the living area. A Heating Assessment Tool can be used to check if your current fixed heater(s) are sufficient or if you’ll need to ‘top up’ with an additional heater. Open fires as well as unflued combustion heaters like the portable LPG bottle heaters are not considered acceptable heating options for The Healthy Homes Standard.

If the heating system you offer is an electric heater or heat source, it must include a thermostat. This makes your heating more consistent and efficient. For the majority of houses, bigger heaters that are fixed, such as wood burners, heat pumps pellet burners, flued gas heaters are needed. In certain situations, like small apartment buildings the smaller fixed electric heater may be sufficient.

Ventilation Pirimai

The insulation of the ceiling and underfloor has been compulsory to all rental homes from 1 July 2019. Property managers and landlords have to ensure that the insulation is up to standards that are in line with the latest standard. In some cases, current ceiling insulation, or the insulation of the sub floor space may need to be topped up or replaced.

A well-insulated property will reduce the risk of condensation and reduce the chances of mould and dampness, as well as making more easy to allow the house to keep heat.
