Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed for a Poukawa rental property, all Healthy Homes compliance tasks need to be finished inside of 90 days.

From the 1st of July in 2021, when a brand new or renewed Tenancy is signed for a Poukawa rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to meet all of the Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t included in the new, renewed or revised tenancy agreement it could result in an additional fine or infringement fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager is unable to supply the required information within 21 days of being informed of the request, they may receive an infringement letter and could be fined up to $750.

In addition, there is also a penalty of up to $900 for landlords and property managers providing a false or misleading Healthy Homes Statement of Compliance or other information. The person liable to pay this fine is the one who is identified on the tenancy agreement as the person who is renting the property which could be the name of the landlord as well as the company that manages the property.

The information contained in the Compliance Statement needs to be up-to-date before the tenancy agreement can be signed, and ideally it is updated throughout the tenancy as any relevant work gets completed.

It is important to note that a landlord who have multiple rental properties may face even higher fines for non-compliance. The most severe penalties are reserved only for serious violations. Those who have more than six properties could be fined as high as $50,000, or as high as $100,000 in the case of hearing claims.

When should I need to be in compliance with The Healthy Homes Standards?

Poukawa Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is required for all Poukawa and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included in any new, renewed or modified tenancy agreement.
  • Property managers and landlords have to keep records that prove the conformance to any Healthy Homes Standards that apply or will be in force during the tenancy of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers must make sure their rental properties conform according to Healthy Homes Standard within 90 days of a renewal, new or a change in Tenancy.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) must adhere to the Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All households let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.

Heating Poukawa

Rental properties in Poukawa require a reliable source of heating that is able to heat the main or largest living area to at minimum 18 degrees Celsius, even on the coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heat requirements to remain fixed (i.e. not portable) and at minimum 1.5 kW of heating capacity, and meet the minimum capacity for heating required for the main living room. Fires that are open and unflued heaters such as mobile LPG bottle heaters are not considered to be acceptable heating options for those following the Healthy Homes Standard.

If the heating that you offer is electric heating (or heat pump), it should be equipped with a thermostat. This will make the heating more reliable and effective. For most properties, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are required. In certain situations, such as small apartments, a smaller fixed electric heater may be sufficient.

If the living area is already equipped with a fixed heating source, like heat pumps, it might need an upgrade to be able to meet the standards. Certain kinds of heaters aren’t able to be used to achieve the standard since they’re either expensive, inefficient or are unsafe to operate.

Ceiling and underfloor insulation has been compulsory in all rental homes since 1 July 2019. Property managers and landlords are required to make sure the insulation meets the new quality. In some cases, an existing insulation on the ceiling or in the subfloor space may require to be filled with or replaced.

A properly insulated home can reduce condensation, and decrease the risk of mould and dampness and it will make more easy to the home to retain warmth.
