Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed on a Putorino rental property, all Healthy Homes compliance tasks need to be done within 90 days.

As of 1st July 2021, if a new, renewed or varied tenancy is signed on the Putorino rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to meet all of the Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. The person who is liable for this fine is the person who is listed on the tenancy agreement as the one who is who is letting the property and it could be the name of the landlord, or the company that manages the property.

All information in the Compliance Statement needs to be up-to-date at the time that the tenancy agreement is signed, and ideally it should be maintained through the tenancy period as relevant work gets completed.

It’s also important to keep in mind that landlords with several rental properties can face greater penalties for non-compliance. The highest penalties are reserved only for serious violations. Those who have at least six rental properties could be penalised up to $50,000, or as high as $100,000 for hearing claims.

Putorino Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory throughout Putorino and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included with any renewal, new or altered tenancy contract.

Heating Putorino

Putorino rental properties should have a permanent source of heat which can warm the living space to a minimum of 18degC, even during the coldest winter days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heat requirements to be fixed (i.e. not portable) with at least 1.5 Kilowatts in heating capacity, and meet the minimum requirement for heat capacity for the main living space. The Heating Assessment Tool can be used to determine if the existing installed heater(s) are sufficient or if you’ll need to "top up" with a new heater. Fires that are open and unflued heaters like portable LPG bottle heaters aren’t considered acceptable heating options for The Healthy Homes Standard.

If the heating that you provide is an electric heater or heat pump then it must be equipped with an thermostat. This makes the heating more uniform and effective. In most homes, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. In certain situations, such as small apartments small apartments, a smaller electric fixed heater could be enough.
