Fines for Failing to Comply

As of 1st July 2021, if a new or renewed tenancy is signed on a Waipukurau rental property, all Healthy Homes compliance tasks need to be finished by the end of 90 days.

From the 1st of July in 2021, if a new or renewed Tenancy is signed for the Waipukurau rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Inability to adhere to each of Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not incorporated within the new, renewed or amended tenancy agreement there may be an additional fine or violation fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager does not supply the required information within 21 days from receiving the request, they could receive an infringement notification and be fined upto $750.

Additionally, there is also a fine of approximately $900 for landlords or property managers that provide false or incorrect Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is the one who is identified on the tenancy agreement as the person who is leasing the property out, so it could be the name of the landlord, or the property management company.

The information contained in the Statement of Compliance needs to be current when the tenancy agreement is signed, and ideally it should be kept updated during the entire tenancy, as necessary work related to it is finished.

It is important to keep in mind that a landlord who own several rental properties can face even higher fines for non-compliance. The highest penalties are given for severe violations, and landlords who own at least six rental properties could be fined up to $50,000, and even as high as $100,000 for hearing claims.

Tenancies established from 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is compulsory to all Waipukurau and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records to demonstrate compliance with all Healthy Homes Standard that apply or will be in force throughout the tenancy period of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords must make sure their rental properties comply according to Healthy Homes Standards within 90 days of a new, renewed , or altered tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All houses which are rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental homes are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Heating Waipukurau

Rental properties in Waipukurau need to have a stable source of heat that can warm the main or largest living space to at least 18degC, even during the coldest winter days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heat requirements that it be permanently fixed (i.e. not portable) with at minimum 1.5 kW in heating capacity, and it must have the minimum heating capacity needed for the main living room. A Heating Assessment Tool can be used to determine if the existing installed heater(s) are adequate or if you’ll need to "top-up" with a new heater. Unflued combustion and open fire heaters, such as small portable LPG bottle heaters aren’t considered acceptable heating options under those following the Healthy Homes Standard.

If the heating that you offer is an electric heater or heat source, then it must include an thermostat. This will help make your heating more consistent and effective. In most homes, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters will be required. In some instances, like apartments with small spaces, a smaller fixed electric heater could be enough.

If the living area already has a fixed heating source like a heat pump, then it might just need an upgrade to be able to meet the standards. Certain kinds of heaters cannot be used to meet the standard because they’re costly, not cost-effective to run, and/or unsafe to run.
